Element is committed to safeguarding the privacy of its users. This Privacy Policy outlines how your personal information is collected, used, disclosed, and protected when you use the Element app, marketing website, and any and all related services (collectively, “the Services”). By using the Services, you consent to the collection and use of information by Element in accordance with this Privacy Policy. By using this website and the Services, you signify your acceptance of this policy. If you don’t agree to any of the terms included in this policy, do not use the Services.

Information collected

As you use the Services, Element will collect two types of information:

  • Data from user input. This information is voluntarily and directly provided by you while using the Services, such as your name and contact information. 

  • Data from user activity. This includes all other information gathered from your interactions with the Services and marketing messages, like what emails you open and email links you click through, when and how often you access the Services, and what actions you take on each screen. If you choose to engage in Services or research interactions with Element, those interactions are recorded and preserved.

Information not collected

Element is not intended for use by anyone under 13. Element does not knowingly collect any Personal Data from or regarding individuals under the age of 13.

Element is also not intended for citizens or residents of countries other than the United States of America, and does not knowingly collect any Personal Data from them.

How your Personal Data will be used

Your Personal Data will be used for four purposes:

  • To provide and improve the Services. Your information is necessary to understand how you came to the Services, by matching you to advertising sources via your email address, and to provide the Services to you. It is also necessary to improve the Services over time. By combining your Personal Data with that of other users, insights can be developed as to how Element can better serve its customers, and features can be modified or introduced based on these insights.

  • To communicate with you. Your information is necessary for you to receive important notifications related to your account, subscription renewal, and updates about the Services, and responses to your inquiries or requests.

  • To ensure compliance. Your information is necessary to ensure compliance with our Terms of Services and applicable laws and regulations.

  • To ensure security. Your information is necessary for Element to monitor and protect the security of the Services and its users.

Element takes appropriate security measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. The Services incorporate industry-standard security technologies and procedures to safeguard the confidentiality and integrity of your information.

How your Personal Data will be used

Element will not sell, trade, or otherwise transfer your Personal Data to third parties, except to provide your email address to advertising partners as required by them to match source to usage. Your information may be shared with trusted third-party Services providers who assist in directly operating the Services, as long as those parties agree to keep this information confidential and are themselves employing equivalent security measures to safeguard your information.

Your personal information will be retained for as long as necessary to fulfill the purposes outlined in this policy unless a longer retention period is required or permitted by law.

State laws governing states in which Element operates guarantee their residents rights to know certain facts about how their Personal Data is being collected, processed, and used, including:

  • The categories of third parties with whom the business shares the personal information

Correcting inaccuracies

If you identify any inaccuracies in the Personal Data collected by Element, you can correct them by emailing support@elementweather.com.

Right to deletion

Element reserves the right to update or change this Privacy Policy at any time. Any changes to the policy will be reflected on this page, and the updated policy will be effective immediately upon posting. By continuing to use the Services after changes are made to the Privacy Policy, you agree to abide by the changed terms.
